The term “consular legalization” or also known as document certifications, has become viral recently due to the growing demand for foreign investment, international business, and relocation to foreign countries. Official papers and documents issued in one country have no legal value in another country unless they are "consular legalized." In other words, for official papers and documents issued in foreign countries to be recognized and used in Vietnam, they must be certified at Vietnamese Consulates of their home state or their accepted state.

1. Definition of consular legalization in a foreign country

Under Vietnamese law, consular legalization means the competent Vietnamese agencies' certification of stamps, signatures, and titles on foreign papers and documents for being recognized and used in Vietnam. Therefore, in order to be recognized and used in Vietnam, foreign papers and documents must be consular legalized at Vietnamese Consulates of their issuance state or at their accepted state.

For example: the British Virgin Island’s (BVI) Certificate of Good Standing to be legally recognized in Vietnam must be consular legalized in the Vietnamese Consulate in BVI or Singapore since Singapore and Vietnam accepted consular legalization in these countries.

Note:

  1. Official documents (issued by the government of consular legalization state) are only required soft copies for information checking.
  2. Official documents (issued by the government of other states) must have the originals to check their authenticity.
  3. Other papers and documents are required for certification of the stamps and signatures.

  • Foreign businesses are required to legalized papers and documents to open a bank account in Vietnam or set up a branch office in Vietnam.
  • Businesses with foreign branch offices are required to submit consular legalization documents of relevant offices by their mother company’s governmental agencies or banks.
  • Foreigners or overseas students with foreign degrees want to consular legalized their degrees to be used in Vietnam.
  • Foreigners marrying Vietnamese want to consular legalized their identity papers.
  • Other required circumstances.

3. Process of consular legalization in a foreign country

Consular legalization of papers and documents in any country must follow these 6 steps:

  1. Papers and documents issued in foreign states.
  2. Authentication of these papers and documents at Vietnamese Consulates of the issuance state or accepted state.
  3. Diplomatic confirmation in that state.
  4. Diplomatic confirmation by the Foreign Affairs Department or Vietnamese Consulate of that state.
  5. Notarized translation in Vietnam (this can be done yourselves to save cost).
  6. The papers and documents are ready to be used in Vietnam.

4.1 Consular legalization service for use in Vietnam

4.2 Consulting process for consular legalization service in foreign countries

  1. Offer consultation via telephone: GLAC shall exchange information to specify the demand of the customers and propose a feasible solution.
  2. Receive dossiers of papers or documents to be consular legalized: all the papers and documents only needed to be scanned and sent via email to GLAC.
  3. Check and send the dossiers to the legalization country: upon receiving the dossier scans, GLAC shall send them to the issuance country to check if the dossiers are complete and valid for consular legalization.
  4. Notify the cost: GLAC shall notify the customers of the detailed cost and expected date of completion.
  5. Proceed with the legalization: upon agreement confirmation and fee reception, GLAC shall commence sending the dossiers to the foreign countries for consular legalization. Note: the dossiers sending to the country for consular legalization may or may not be required to be originals.
